1. ACCEPTANCE OF TERMS

The website located at agas.org.sg (the “Site”) is owned and operated by the Art Galleries Association Singapore (“AGAS”, “we”, “us”). By accessing or using the Site, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please refrain from using the Site.

2. INTELLECTUAL PROPERTY RIGHTS

  • Ownership: All content on this Site—including text, the member directory, logos, and images—is the property of AGAS or its members and is protected by Singapore and international copyright laws.
  • Prohibited Use: You may not reproduce, redistribute, or use any artwork images or member contact data for commercial purposes or “data mining” without express written permission from AGAS.
  • Limited License: We grant you a personal, non-exclusive license to view and print pages for personal, non-commercial use only.

3. MEMBERSHIP & PROFESSIONAL CONDUCT

AGAS is an industry body that governs professional and ethical gallery practice. We reserve the right, at our sole discretion, to remove any member listing or gallery content that we deem to be in breach of the AGAS Code of Professional and Ethical Gallery Practice or that may damage the reputation of the Singapore arts community.

4. TICKETING & EVENTS

  • Sales Policy: All ticket sales, including the “Patron’s Pass,” are final and non-refundable.
  • Event Variations: AGAS reserves the right to change event venues, artist lineups, or tour routes without prior notice.
  • Force Majeure: AGAS shall not be liable for any failure to host events or provide Site access due to causes beyond our reasonable control, including but not limited to public health emergencies, government restrictions, or environmental factors (e.g., haze-related closures).

5. DISCLAIMER OF LIABILITY

  • Non-Agency: AGAS acts as a representative body, not as an art dealer or agent. Any transaction for the purchase of art is a private contract between the buyer and the member gallery.
  • No Warranty: AGAS does not warrant the authenticity, condition, or investment value of any artwork listed by its members. To the fullest extent permitted by Singapore law, AGAS disclaims all liability for any loss or damage arising from your use of the Site or reliance on its content.

Personal Data Protection Policy (PDPA)

1. OUR COMMITMENT

AGAS is committed to protecting your privacy in accordance with the Singapore Personal Data Protection Act (PDPA). This policy outlines how we collect, use, and safeguard your personal data.

2. COLLECTION OF DATA

We collect personal data (such as name, email, and contact details) when you:

  • Register for an AGAS Membership.
  • Purchase a Patron’s Pass or event tickets.
  • Subscribe to our newsletters or RSVP for gallery events.

3. USE & DISCLOSURE OF PERSONAL DATA

Your data is used to manage your relationship with AGAS and to provide you with industry updates. For Patrons and VIPs, you acknowledge and consent that your name may be shared with specific member galleries for the sole purpose of verifying entry to private previews or exclusive collectors’ tours. We do not sell your personal data to third parties.

4. DATA SECURITY

We implement appropriate administrative and technical measures (such as SSL encryption and secure databases) to protect your data. While we strive to protect your information, no method of transmission over the internet is entirely secure.
